Background
According to the US Immigration and Naturalization Service (INS), deportation refers to the official removal of any resident (non-citizen) from the United States if he is found violating immigration law. In the past, many individuals have been deported from United States for a number of reasons: rebelling against the US government, having a criminal record, illegally entering the country.
The most famous incident regarding deportation in the United States occurred in the twentieth century when a large number of immigrants were deported after being identified as the prison guards of Nazi concentration camps during the Holocaust.
The Deportation Process
Deportation of an individual is initiated by issuing a Notice to Appear which outlines the charge that the Government has against the alien. An alien may be imprisoned and a bond may be issued to warrant someone realize which the immigration proceedings are taken place.
A hearing before an immigration judge is scheduled. An attorney is present at the hearing to represent the government and the person to be deported can also seek legal representation.
The judge is hears both sides before arriving at any decision. The ruling made by the judge is subject to appeals from both sides to the board of immigration appeals. The losing side, upon the ruling by the BIA is permitted to appeal through the federal courts as well.
Voluntary Departure
An alien may voluntarily decide to leave the United States before being Ordered Deported. This practice serves the same purpose as that of deportation but it lets the individual to depart with some hope of returning. However, such candidates must be able to bear their own transportation costs.
Inadmissible Aliens
Some aliens are forbidden to enter United States because of their inability to meet certain necessary requirements in spite of their legal immigration process. The following are the reasons for which an individual may be inadmissible: communicable diseases, criminal record and physical and mental disorders.
Persons with diseases such as tuberculosis, AIDS, typhoid or any other such disease are not allowed to enter the US as they can possibly infect others. Any person who bears a strong criminal record is prohibbited from entering US. Entry to any person involved in drug trafficking, murder or rape is strictly prohibited. Same is applied to those convicted of treason, espionage, any sort of violent activity against the State, and activities related to terrorism. Additionally, any immigrant bearing a physical or mental disorder is not allowed to enter US until he or she proves that the disorder has been cured.
